About these terms
These Company Terms are between Cedar House Marketing LLC of Franklin, Tennessee ("we", "us") and the company you are signing up ("you", "your company"). They sit alongside the Terms of Service and the Privacy Policy, and they apply to Cedar House Stack and its field app, whether you use them on a trial, a demo or a paid plan. You are accepting them for your company, and you confirm you are allowed to do that.
Confidentiality
Each of us will keep the other's non-public information confidential and use it only to provide or use the Stack. That includes the Stack's features, screens, pricing, roadmap and anything we share in support or a demo, and your company's customer, job and pricing data. This does not cover information that is public, that you already had, or that you are legally required to disclose. These duties last while you use the Stack and for three years after, and for trade secrets as long as they remain trade secrets.
No competitive use
You will not, and will not let anyone else:
- copy, reverse engineer, decompile, scrape or rebuild the Stack or any part of it;
- use the Stack, a trial or a demo to design, build or market a competing product;
- publish benchmarks or comparisons of the Stack without our written permission;
- resell the Stack or share access with anyone outside your company.
This does not stop you from using any other software you choose.
AI output
Some features generate estimates, texts, summaries, call notes and phone calls with artificial intelligence, and that output can be wrong. Your company reviews anything it sends, prices or relies on. The AI receptionist tells callers it is an AI assistant and that the call is recorded.
Texts and calls to your customers
Your company is responsible for having consent before it texts or calls anyone (including under the Telephone Consumer Protection Act), for honoring STOP and opt-out requests, and for quiet hours. The Stack's consent records, STOP handling and calling-hours limits help, but they do not make your company compliant on their own.
Call recording
Some states require every party's consent before a call is recorded. Your company gives notice and gets consent wherever it is required. The Stack's recorded-call announcement helps with this.
Location sharing
The field app and "On my way" share a person's location with their company while the app is in use as described in the app. Your company tells its people this, and follows any state rules on notice for tracking employees.
Storm data, measurements and estimates
Hail sizes, storm paths and reports are estimates from public weather sources. They show where damage is likely, not that any roof is damaged or that a claim will be paid. Aerial and calculated measurements are approximate. Verify on site before ordering material or signing a price.
Insurance claims
The Stack documents damage and prepares estimates. It does not negotiate insurance claims. In Tennessee, negotiating a claim on a homeowner's behalf requires a public adjuster license (Tenn. Code Ann. Title 56, Chapter 6, including section 56-6-914 on contract terms), and a roofing contractor without that license may not negotiate a claim. Other states have their own rules. Your company is responsible for staying within them.
Payments and financing
Card payments run through the payment processor your company connects, and financing through the lenders your company chooses. We are not a lender or a payment processor and do not decide approvals.
No professional advice
Nothing in the Stack is legal, tax, insurance or engineering advice.
30-day money-back guarantee
Use the Stack and the field app the way they are built for your first 30 days, and if your company doesn't win a job with them, we refund your first month's subscription. Winning a job means an estimate signed or a job marked sold in the Stack or the field app during those 30 days. The 30 days start the day your first paid month starts. Before a first payment there is no guarantee period.
To qualify, your company completes the usage checklist below, measured automatically from your account rather than from anything you fill in. The same checklist is shown live on the Guarantee card in Plan & billing and in the field app's Manager Report, so you can see where you stand at any time.
For the Stack: finish setup (your company profile, your logo, and your own price book or estimate template); someone signs in on at least 12 of the 30 days; and send at least 5 estimates to homeowners.
For the field app: at least 2 reps log doors on at least 10 different days; at least 300 doors logged; at least 20 leads or recorded conversations captured; and at least 5 appointments or inspections set.
A company using both products completes both checklists. The work also has to be spread across the month rather than saved for the last days: the 30 days are divided into 3 equal blocks and each block needs at least 2 days with real work in it. Demo, trial and sample data don't count, and deleting records doesn't reset anything. The request must be made between day 30 and day 45, the account must be in good standing with no chargebacks, each business can use the guarantee once, recognized by its tax ID, payment details, phone, web domain or address. The refund covers the first month's subscription only. Pass-through usage already used, such as postcards mailed and measurement reports delivered, is not refunded. We review each request and email the outcome.
You can ask even if the checklist isn't finished. Being short of it doesn't stop you requesting a refund and doesn't decide the answer on its own: a person reads the request, sees what your account actually did, and replies. What the guarantee does not cover is a demo or sample account, a business that has already used its one guarantee, an account with a chargeback on record, and a company that won a job in its first 30 days, which is the guarantee having done its work.
An EIN is not required to ask. We may need one to pay a refund out, and if your business doesn't have a federal EIN, or you canvass on your own so the field checklist can't reasonably apply, contact us before day 45 and we will work it out with you.
Service and limitation of liability
The Stack is provided as is. We keep backups but do not promise uninterrupted or error-free service. To the extent the law allows, neither of us is liable for indirect, incidental or consequential damages, and our total liability is limited to the fees your company paid us in the twelve months before the claim.
Governing law
Tennessee law governs these terms, and the state or federal courts serving Williamson County, Tennessee hear any dispute about them.
Changes
When these terms change, the new version is shown at your next sign-in and must be accepted before you continue. We never change an accepted version silently.
Electronic signature
By ticking the box and pressing Agree, you are signing electronically and agreeing that this has the same effect as a handwritten signature. We email you a copy where email is available, you can print or save one from the agreement page at any time, and you can ask us for a paper copy.
